Important 3/27 Update from Business Manager Steve Flores
March 27, 2020
Dear 393 Members and Contractors,
During the coronavirus pandemic, we will be providing our members with updated information to help them navigate this crisis. This will be done via email blasts and communications posted on our website (www.ualocal393.org). Please make sure you have all of the pertinent information we have provided by reading the communications posted on our website beginning March 16, 2020.
Below are our latest updates:
In the update I sent on March 24, 2020, I stated that “Beginning today, March 24, 2020, all UA members who signed out of work via the UA Local 393 Emergency Out-of-Work line (408-755-5627), may call back and ask to be removed from the out-of-work list one (1) time. This one-time request to be removed from the list will be allowed for two weeks ending April 7, 2020.” This update led to the following questions:
- Question: If a 393 member is removed from the out-of-work list, is that member eligible to receive unemployment benefits from the EDD and the Supplemental Unemployment Benefits (SUB) provided to our members through the 393 Trust Funds?
- Answer: Yes
- Question: Why would a member want to be on or not on the out of work list?
- Answer: This is judgment call each member must make for themselves. However, I can explain the main difference regarding returning to work when a jobsite reopens:
- If a member is on the out of work list, the employer must request a “Return to Immediate Previous Employer” dispatch from the union to bring that member back to work.
- If a member is not on the out-of-work list, the employer does not have to go through the hiring hall process and only has call the member back to work.
- Because we do not know when a project will reopen or if it will reopen at all, each member must make their own decision.
