Strike Is Still On

July 15, 2021

Dear UA Local 393 Sisters and Brothers,

We had a Special Called Meeting on Wednesday, July 14, 2021. At the meeting the membership voted to reject the Last, Best and Final Offer from NCMCA and UMIC (Northern California Mechanical Contractors’ Association and Industrial Contractors – UMIC Inc.) and the contractors they represent. The membership then voted to continue to strike these organizations and the contractors they represent.

So, 393 members employed by any of the contractors represented by NCMCA and UMIC are still on strike, with a few exceptions.

  • The Service Agreements (Northern California and Northern Nevada Refrigeration and Air Conditioning Agreement; UA / MSCA National Service and Maintenance Agreement) have no strike clauses. So, members working under these agreements may not strike.
  • PLAs and MEPS Agreements have no strike clauses. So, members working on projects covered under a PLA or an MEPS Agreement may not strike.
  • Also, members working in prefab shops for contractors signatory to the UA National Fabrication Agreement (Yellow Bug Agreement) may not strike.

A communication listing all the contractors represented by NCMCA and UMIC was emailed to all our members and posted on our website on June 26, 2021. A communication listing all the projects covered under PLA’s (these agreements are negotiated through the Santa Clara and San Benito Counties Building Trades Council) was emailed to all our members and posted on our website June 26, 2021.

393 residential plumbers are not subject to this strike since they work under a separate, unrelated contract.

Sincerely,

Steve Flores

Business Manager
